Terms, payments, subscriptions, and refund policy for Castkro

These Terms of Service ("Terms") constitute a legally binding agreement between you and Castkro Inc. ("Castkro," "we," "us," or "our") governing your access to and use of the websites under the domain names www.castkro.com and www.castkaro.com (collectively, the "Platform" or "Websites"), including all functionality, services, features, and content offered on or through the Platform.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Platform.

1. Introduction and Acceptance of Terms

By visiting or using the Platform, including access through any computer, mobile device, or mobile application, you accept and agree to be bound by these Terms regardless of whether you choose to register with us. You further agree to comply with all applicable local, state, national, and international laws and regulations.

Age Requirement: You affirm that you are either (a) at least eighteen (18) years of age, or (b) an emancipated minor, or (c) possess legal parental or guardian consent, and are fully able and competent to enter into and comply with these Terms. Minors under 18 may only use the Platform with the involvement and supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Platform Services and Premium Features

Castkro operates a digital marketplace connecting entertainment industry professionals, including but not limited to casting directors, talent agents, producers, and performers (collectively, "Users"). The Platform provides:

• Casting call postings and audition opportunities
• Performer profiles and digital portfolios
• Communication and messaging tools
• Industry resources, articles, and educational content
• Search and discovery features

Premium Services: Certain features and services require purchase of a subscription or one-time payment ("Premium Services"), including but not limited to:

• Enhanced profile visibility and priority placement
• Unlimited casting call postings
• Advanced messaging and communication features
• Access to premium casting opportunities
• Analytics and reporting tools

3. Payments, Subscriptions, and Billing

3.1 Subscription Plans

Premium Services are offered on a subscription basis (monthly or annual) or as one-time purchases. By subscribing to Premium Services, you authorize Castkro to charge your chosen payment method on a recurring basis until you cancel your subscription.

Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date. You will be charged the then-current subscription rate unless you cancel before the renewal date.

Price Changes: We reserve the right to modify subscription pricing with at least 30 days' advance notice. Continued use of Premium Services after the effective date of a price change constitutes acceptance of the new pricing.

3.2 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@castkro.com. Cancellation will take effect at the end of your current billing period, and you will retain access to Premium Services until that date. No partial refunds are provided for unused time in a billing period.

3.3 Payment Processing

All payments are processed securely through third-party payment processors. You agree to provide accurate, current, and complete payment information and to update this information promptly if it changes. Castkro is not responsible for any fees charged by your financial institution related to payment processing.

4. Refund Policy

Limited Refund Availability: Due to the immediate and substantial value delivered through our marketplace services, refunds are available only under specific circumstances outlined below. This policy applies to all subscription plans, one-time purchases, and Premium Services.

4.1 Eligibility for Refunds

7-Day Money-Back Guarantee (Limited):

New subscribers may request a full refund within seven (7) calendar days of their initial purchase if all of the following conditions are met:

• No casting calls have been posted (for casting directors/recruiters)
• No audition submissions or applications have been made (for performers/talent)
• No messages have been sent through Premium messaging features
• No connections, matches, or contact information exchanges have occurred
• No Premium content has been downloaded or accessed

Important: Once you have utilized any Premium Service features—including posting castings, submitting auditions, making connections, or exchanging contact information—no refund will be provided, regardless of the outcome or your satisfaction with the service.

4.2 Non-Refundable Circumstances

The following are explicitly non-refundable:

• Subscriptions after the 7-day window, regardless of usage
• Any subscription or service where Platform features have been actively used
• Dissatisfaction with quality or quantity of responses, auditions, or casting opportunities
• Lack of success in securing roles or finding suitable talent
• Changes in personal circumstances or project cancellations
• Failure to cancel subscription before automatic renewal
• Account suspensions or terminations due to Terms of Service violations
• Annual or multi-month subscriptions after the initial 7-day period

4.3 Technical Issues and Service Credits

If the Platform experiences significant technical failures or downtime exceeding 24 consecutive hours that prevents you from using paid features, you may be eligible for:

• Account credit for the affected period (calculated on a pro-rata basis)
• Extension of your subscription period to compensate for downtime
• Partial refund at our discretion for documented, sustained service disruptions

To request a credit or refund for technical issues, you must report the problem to support@castkro.com within 48 hours of the incident with documentation of the issue.

4.4 Refund Request Process

To request a refund, contact support@castkro.com with:

• Your account email address and username
• Transaction ID or receipt
• Detailed reason for refund request
• Date of purchase

Refund requests are reviewed within 3-5 business days. Approved refunds are processed to the original payment method within 7-10 business days. We reserve the right to deny refund requests that do not meet the eligibility criteria outlined above.

4.5 Abuse of Refund Policy

Castkro reserves the right to deny refunds and suspend or terminate accounts that demonstrate patterns of refund abuse, including but not limited to: repeated subscription and refund cycles, fraudulent claims, chargebacks, or attempts to exploit the refund policy. Users who engage in refund abuse may be permanently banned from the Platform.

5. Proprietary Rights and Intellectual Property

Castkro and its licensors own, operate, and control all rights, title, and interest in and to the Platform, including all Content (excluding User Provided Content), software, trademarks, service marks, trade names, logos, design elements, source code, algorithms, and other intellectual property.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Platform or any Content without express written permission from Castkro. The Castkro name, logo, and all related marks are trademarks of Castkro Inc. and may not be used without prior written consent.

6. User Accounts and Profiles

6.1 Account Creation

To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security: You must immediately notify Castkro of any unauthorized use of your account or any other security breach. Castkro will not be liable for any loss or damage arising from your failure to maintain account security.

6.2 Profile Accuracy

You represent and warrant that all information in your profile, including but not limited to your name, credentials, experience, skills, and portfolio materials, is accurate, truthful, and not misleading. Misrepresentation of your qualifications, experience, or identity may result in immediate account termination.

6.3 Professional Conduct

All Users must conduct themselves professionally and respectfully. The Platform is intended for legitimate business purposes within the entertainment industry. Any use of the Platform for harassment, discrimination, fraud, or illegal activities is strictly prohibited.

7. User Provided Content

7.1 Submission of Content

The Platform allows you to upload, post, or transmit various materials including but not limited to photos, videos, headshots, demo reels, resumes, casting calls, audition materials, messages, and other content ("User Provided Content"). You retain ownership of your User Provided Content, but you grant Castkro certain rights as described below.

7.2 License Grant

By submitting User Provided Content to the Platform, you grant Castkro a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Provided Content in connection with operating and promoting the Platform and Castkro's business. This license continues for a commercially reasonable period after you remove or delete your User Provided Content from the Platform.

7.3 Content Standards and Prohibited Content

You represent and warrant that your User Provided Content:

• Does not infringe any copyright, trademark, patent, trade secret, or other intellectual property rights
• Does not violate any person's rights of publicity, privacy, or confidentiality
• Does not contain unlawful, defamatory, libelous, threatening, or harassing material
• Does not contain sexually explicit, obscene, or pornographic material
• Does not promote discrimination, hatred, or violence against any individual or group
• Does not contain viruses, malware, or other harmful code
• Complies with all applicable laws and regulations

7.4 Content Monitoring and Removal

Castkro reserves the right, but has no obligation, to monitor, review, edit, or remove any User Provided Content at any time and for any reason, including but not limited to Content that violates these Terms, is reported by other Users, or is deemed inappropriate or harmful. We do not pre-screen User Provided Content, and you acknowledge that other Users may post Content that you find offensive, inaccurate, or objectionable.

8. Casting Directors and Recruiters: Special Obligations

If you post casting calls or recruit talent through the Platform, you agree to additional obligations:

Accurate Representations: All casting calls must accurately represent the role, production, compensation, requirements, and working conditions. Misrepresentation of any material fact is grounds for immediate removal and potential account termination.
Compensation Disclosure: You must clearly state whether a role is paid, unpaid, deferred payment, or offers alternative compensation (credit, copy, meals, travel reimbursement, etc.).
No Exploitation: You may not request, suggest, or imply any form of sexual or romantic relationship as part of the audition or casting process. You may not request personal favors, gifts, or any form of compensation from talent in exchange for roles or auditions.
Professional Settings: All auditions and callbacks must occur in professional, public settings such as studios, theaters, production offices, or other legitimate business locations. Private residences and hotel rooms are not acceptable audition venues.
No Pay-to-Play: You may not require talent to pay any fees, dues, or charges to audition, apply, or be considered for roles.
Compliance with Labor Laws: You agree to comply with all applicable employment, labor, and entertainment industry regulations, including proper classification of workers, payment of minimum wages, and provision of safe working conditions.

Violation of these obligations will result in immediate listing removal, account suspension or termination, and potential reporting to law enforcement or industry organizations.

9. Limited License to Use Platform

Subject to your compliance with these Terms, Castkro grants you a limited, personal, non-exclusive, non-commercial, revocable, non-assignable, and non-transferable license to access and use the Platform for its intended purposes, including:

• Creating and maintaining a profile for professional purposes
• Searching for and applying to casting opportunities (talent)
• Posting casting calls and reviewing applicants (casting directors)
• Communicating with other Users through Platform messaging
• Viewing and downloading Content for personal, non-commercial use

10. Restrictions on Use

You agree not to:

• Use the Platform for any illegal purpose or in violation of any laws
• Scrape, data mine, or use automated tools to collect information from the Platform
• Circumvent or disable any security features or access controls
• Impersonate any person or entity or misrepresent your affiliation
• Use the Platform to spam, harass, or send unsolicited communications
• Interfere with or disrupt the Platform or servers/networks connected to the Platform
• Attempt to gain unauthorized access to any portion of the Platform
• Reverse engineer, decompile, or disassemble any aspect of the Platform
• Remove or alter any proprietary notices or labels
• Use the Platform for commercial purposes without authorization
• Create multiple accounts to evade restrictions or bans

11. Third-Party Content and External Links

The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by Castkro. We do not endorse or assume any responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge and agree that Castkro is not liable for any damage or loss caused by your use of any third-party content or services.

Certain Content on the Platform is provided by third parties, including other Users. Castkro makes no representations or warranties as to the accuracy, completeness, or reliability of such third-party content.

12. Copyright Infringement and DMCA

Castkro respects intellectual property rights and responds to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Platform, please notify our Copyright Agent with the following information:

• A physical or electronic signature of the copyright owner or authorized representative
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on the Platform
• Your contact information (address, telephone, email)
• A statement of good faith belief that the use is not authorized
• A statement of accuracy and authorization under penalty of perjury

14. Disclaimers and Platform "AS IS"

THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, CASTKRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or completeness of Content
• Warranties that the Platform will be uninterrupted, secure, or error-free
• Warranties regarding quality of services, roles, or opportunities obtained through the Platform

CASTKRO DOES NOT VERIFY THE IDENTITY, CREDENTIALS, OR BACKGROUND OF USERS. You are solely responsible for evaluating and verifying the legitimacy of opportunities, Users, and any agreements you enter into through the Platform.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTKRO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content
• Failed auditions, lost opportunities, or unsuccessful castings
• Disputes between Users

IN NO EVENT SHALL CASTKRO'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO CASTKRO IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.

16. Indemnification

You agree to indemnify, defend, and hold harmless Castkro, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Platform
• Your violation of these Terms
• Your User Provided Content
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

17. Account Termination and Suspension

Castkro reserves the right to suspend or terminate your account and access to the Platform, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Multiple User complaints or reports
• Prolonged inactivity
• Request by law enforcement or government agency

Upon termination, your right to use the Platform immediately ceases. Castkro is not liable for any losses resulting from account suspension or termination. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) shall survive.

18. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

18.1 Informal Resolution

Before initiating arbitration or court proceedings, you agree to first contact Castkro at support@castkro.com to attempt to resolve any dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice.

18.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator and shall take place in Punjab, India.

18.3 Class Action Waiver

YOU AND CASTKRO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of [Your State/Province] and the federal laws of [Your Country] applicable therein, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the courts located in Faridkot, Punjab.

20. Changes to Terms

21. General Provisions

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Castkro regarding the Platform.

21.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21.3 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

21.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without Castkro's prior written consent. Castkro may assign these Terms without restriction.

21.5 Force Majeure

Castkro shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
